The federal ban on carrying firearms at U.S. Post Offices and postal properties nationwide is being strongly challenged.

The Second Amendment Foundation, Firearms Policy Coalition, and two Texas citizens filed a federal lawsuit in the Lone Star State challenging the ban. The defendant is Attorney General Merrick Garland.

SAF Founder and Executive Vice President Alan M. Gottlieb explained the basis for the legal action.

“Under the Bruen ruling of June 2022, if the government seeks to restrict firearms in a particular location as a ‘sensitive place,’ it must prove that its current restriction is sufficiently analogous to a well-established and representative historical analogue.”

Which, of course, is not the case with the postal ban.

SAF Executive Director Adam Kraut further explained the reasoning of the gun rights group.

“Current federal law bars the ‘knowing possession’ of firearms in federal facilities, which includes post offices. Millions of legally armed private citizens, whose daily routines may include visits to post offices to pick up or drop off mail, are directly impacted by this infringement. There is no well-established, representative historical analogue to justify this regulation, which violates the Second Amendment.”

Simply put, the federal government and lawmakers must rely on the Constitution and the Founding Fathers’ intent to limit the rights of law-abiding citizens to carry firearms. 

Unlike what had become the trend before the monumental Bruen decision, it is not enough to merely propose any restriction and expect it to pass constitutional muster. In this manner, the Second Amendment was quickly being nullified through government regulations and local acts.

But no more.

If the current prohibition on the legal carry of weapons at postal facilities is not shown to have historical precedent, it should be swept aside. This case will not be decided quickly, but it is an essential step toward restoring the liberties enjoyed by good citizens for centuries.
