With the dust now settling on the U.S. Supreme Court’s decision striking down the federal ban on bump stocks, many would assume that the ruling by the highest court in the land would enable law-abiding citizens to utilize these popular accessories once again.
Not so fast.
By a 6-3 majority, justices determined that the prohibition on bump stocks enacted in 2018 after the Las Vegas mass shooting was a federal overreach.
Unfortunately, for many, this decision does not affect state laws.
Instead, states such as Illinois that severely hamper Second Amendment rights remain free to keep their laws on the books. The Supreme Court decision also permitted bans to remain in California, Connecticut, Florida, Hawaii, Maryland, New York, New Jersey, Massachusetts, Delaware, Minnesota, Vermont, Rhode Island, Nevada, Washington and Washington D.C.
There may be relief from these remaining bans on the horizon, and once again, it is up to the high court. Justices will decide soon whether to accept a challenge to the sweeping 2023 Illinois gun control package.
Not only did it prohibit so-called “assault weapons,” it also banned bump stocks in the state. This came after the Highland Park shooting in 2022, and lawmakers enacted the measures in an emotional special session.
A favorable ruling for gun rights supporters would go far in striking down state-level laws.
Yet again, Second Amendment proponents are caught in a holding pattern as states enact law after law to suppress their constitutional rights. However, relief may come from the Supreme Court, and many will watch closely in the days and weeks ahead for a signal that justices will hear the Illinois litigation.
A court ruling in favor of gun rights would go far in rolling back the clock to before the current rush of attacks on personal freedoms began.
