In a sharp contrast to the precise wording of the Second Amendment, New Jersey lawmakers established that an individual must demonstrate a “justifiable need” to carry a weapon lawfully.

Of course, the Bill of Rights does not make such a stipulation, and neither does the nation’s history and tradition of firearm regulations, as required by the U.S. Supreme Court.

Now, the District Court of New Jersey handed a remarkable victory to the Firearms Policy Coalition (FPC) in ruling on Thursday that the state provision violated the Second and Fourteenth Amendments.

The court further mandated that the defendants pay court costs for the litigation.

FPC President Brandon Combs celebrated the decision. “We are delighted to successfully conclude this challenge to New Jersey’s authoritarian disarmament scheme. We will continue to fight forward until all peaceable people can exercise the right to bear arms in public without fear of government harassment or prosecution.”

The gun rights organization and two of its members filed suit against the state in 2021 over the clearly unconstitutional statutory stipulation of a justifiable need to carry a weapon. The following year, the Supreme Court issued its landmark Bruen ruling, which even further pushed New Jersey’s action out of bounds.

States led by anti-gun lawmakers are increasingly ignoring the Constitution and the will of the Supreme Court in suppressing gun rights. Now, more than ever, it is critical that all freedom-loving Americans step up and support organizations on the front lines of defending the Second Amendment.

As New Jersey officials well know, there has never been a mandate to demonstrate a need to enjoy liberties granted by the Bill of Rights. Instead, they exist independently and are to be exercised in the broadest terms allowable while protecting individual rights.

It is wholly unnecessary to crawl to the government and beg for permission to defend yourself. That ridiculous concept must be opposed at every turn.
