New Mexico Gov. Michelle Lujan Grisham’s (D) quest to stamp out the Second Amendment drew yet another court challenge, and gun rights advocates are lined up to be heard.
Of course, her previous blanket ban on carrying firearms in Albuquerque and Bernalillo County was so unconstitutional and outrageous that she was forced to hastily retreat.
All that remains of her misguided action is an executive order prohibiting weapons in parks and playgrounds, and she renews it every 30 days. This routine has played out for nearly a year.
But now the order is under tremendous legal pressure, and oral arguments in Fort v. Grisham are scheduled for next month before the Tenth Circuit.
Last week, the Firearms Policy Coalition (FPC) stepped up and filed a brief with the appeals court. The filing explained that “after accounting for the issues the Court has raised, it remains the case that the court should reverse the decision below and order entry of an injunction against the challenged provisions of the Governor’s order.”
The advocacy group declared that plaintiffs would make their presence felt in parks not under the governor’s order and that they suffer “irreparable harm.”
The FPC added, “The governor’s ban harms appellants, and their harm can be redressed by a preliminary injunction.”
Oral arguments are set for September 25. That date is over a year since Grisham attempted a constitutional coup and ignited a firestorm of controversy.
A broad coalition of citizens and even law enforcement rose in unison against the blatant overreach, resulting in an embarrassing spate of backtracking for the governor’s office. The Tenth Circuit could complete the reversal and take a strong stand for New Mexicans’ individual rights.
The FPC is joined in the litigation by the Second Amendment Foundation (SAF) and the New Mexico Shooting Sports Foundation.
