Far too many cases of obvious self-defense still become entangled in the criminal justice system. 

Even when the facts clearly indicate that a law-abiding citizen did what was necessary to protect themselves and others, misguided prosecutors may force the intended victim to suffer through a trial and the uncertainty it brings.

This was the fate of a Baltimore security guard, 21-year-old Darius Daye, who was finally acquitted late last month on double homicide charges. The case stemmed from an incident in January when the young man was working at an auto repair shop in a neighborhood that was under siege by criminal violence.

The area suffered several shootings, including a recent triple homicide and another murder at a different auto repair center.

The defense explained that three men unexpectedly entered the business and shot one of the employees. As a security guard, Date was armed and immediately returned fire.

Two of the attackers were struck and died from their injuries.

This would have been a clear-cut example of justified self-defense in another city and state. But it was Baltimore, Maryland, and both jurisdictions are led by anti-Second Amendment politicians who do not value the fundamental right to keep and bear arms.

That meant that Daye faced felony charges that could keep him behind bars for the rest of his life. Fortunately for him, defense attorney Chris Purpura successfully argued that his client’s life was in danger and that the law, even in Maryland, allows the use of deadly force in such a situation.

Daye, he insisted, had no choice but to act quickly and decisively. The jury ultimately agreed.

The young man may now get on with his life and close the book on the terrifying January incident. But his plight is a warning to others facing such violent threats that they may be forced to defend their actions in court despite the obvious circumstances.
