Anti-gunners increasingly use so-called “red flag” orders to strip Second Amendment rights away from law-abiding citizens with merely an unverified accusation.
Understand that these protection orders are undoubtedly necessary in rare cases, but due process must be observed.
A Texas state lawmaker, Rep. Briscoe Cain (R), introduced House Bill 162 recently. This measure, known as the “Anti-Red Flag Act,” seeks to rein in local and state governments from using these orders to erase gun rights.
It further prohibits the insidious incentivizing program by federal agencies to increase the implementation of red flag laws.
Not only may citizens lose their gun rights without a day in court and the ability to confront their accuser, but false reports leading to such orders may be filed without penalty.
Cain’s bill establishes consequences for falsely accusing another person of being a threat.
If the bill passes, state and local entities would be barred from enacting red flag laws unless they are “expressly authorized by Texas law.” HB 162 would establish that federal regulations are unenforceable if they do not protect the accused’s due process rights.
Further, persons “who serve or attempt to serve a red flag order within Texas unless the order was issued under Texas law” would be subject to imprisonment.
Cain explained that his bill protects law-abiding Texans from Washington, D.C. and reestablishes their due process rights.
“HB 162 is about standing up for the constitutional rights of Texans, ensuring that citizens are not stripped of their rights without due process,” the senator declared. “This bill is a clear message that Texas will not bow to federal overreach and will always protect the freedoms guaranteed by our Constitution.”
Currently, 21 states and the District of Columbia have red flag laws on the books. There is a growing issue with local governments, especially in larger cities, enacting these statutes without necessary protection for due process and the ability to appeal.
At least one Texas lawmaker is attempting to address this injustice.
