The war over the Texas State Fair banning concealed carry last year rages on, and now state lawmakers stepped into the fray.
State Rep. Brisco Cain (R) introduced HB 1715 to end the controversy permanently. His measure would expressly forbid banning concealed carry on state-owned property, which fair organizers successfully accomplished in 2024.
The bill’s language would bar “government entities, courts or contractors” who utilize state property from banning a licensed citizen from carrying a weapon unless they are “otherwise prohibited from carrying handguns on the property.”
The city of Dallas owns State Fair Park and hosts the popular annual event.
Second Amendment advocates were blindsided last August when officials announced the policy revision. Under the revised policy, all fairgoers, including those licensed to carry, would be prohibited from bringing weapons into Fair Park while the gates were open.
Many were shocked that such a policy was enacted in the Lone Star State, which is typically a bastion of gun rights.
Texas Attorney General Ken Paxton (R) acted quickly, writing to the State Fair Board to explain that their actions violated state law. He further threatened legal action if the controversial policy was not rescinded.
But State Fair officials dug in their heels. First, a Dallas district court and a Texas appeals court rejected the state’s position in favor of gun rights.
And when the Texas Supreme Court rejected Paxton’s petition, the State Fair was free to prohibit carry by attendees.
When the 2024 fair closed its gates, it did not signal the end of robust challenges to the policy. Paxton and three attendees pursued legal action against organizers, and now, the proposed legislation would enshrine the right to bear arms on government property.
There may well be a new policy in effect by the time the 2025 Texas State Fair welcomes guests back this fall.
