There is a seismic shift underfoot when it comes to marijuana, and unfortunately, there are lawful gun owners who are ensnared in legal limbo.

As more and more states accept cannabis for medicinal purposes and even recreational use, political leaders are grappling with a decades-old federal law.

As surprising as this is for 2025, the government still considers marijuana to be a hard drug in the vein of cocaine and heroin. With this classification, even those who partake for prescribed medicinal purposes must surrender their Second Amendment rights. 

The top lawmaker in Kentucky aims to change this.

Gov. Andy Beshear (D) supports a state resolution urging the U.S. Congress to amend the Gun Control Act of 1968 and permit medical marijuana users to retain their gun rights.

Beshear came out last week with a strong message backing the measure. “Law-abiding Kentuckians, or any American for that matter, shouldn’t have to choose between a constitutional right, like the Second Amendment, and getting the medication that they need.”

The governor noted the prevalence of the drug’s applications for military veterans suffering from PTSD.

“Think about some of the veterans that we’ve had at this podium that have talked about what medical cannabis has done for them,” Beshear declared. “I mean, denying these rights to people who have carried arms in our defense outside of this country is not something we should be doing.”

Advocates for gun rights for marijuana users argue that the law already prohibits intoxicated individuals from handling weapons. The difference is that those who consume alcohol retain their Second Amendment rights as long as they are not under the influence at the moment.

Marijuana users, many argue, should be treated the same.

Thousands of Kentucky citizens possess medical marijuana cards, and it is in wide use as a less addictive alternative to other pain treatment options.
