When faced with a potentially deadly attack from a violent criminal, there is hardly enough time to consider possible legal ramifications to defending oneself. That comes later.

For one North Carolina woman who courageously stood up to an attacker and used lethal force, the news is positive.

Police in Wilmington announced that the woman who defended herself in mid-February will not face charges. Investigators determined that the man who died in the confrontation was the aggressor.

On Tuesday, the Wilmington Police Department issued a press release detailing their findings.

Law enforcement officials believe 36-year-old James Timothy Scott approached a group of three people in a wooded area outside of a Wilmington neighborhood. The suspect allegedly brandished a knife and threatened to kill them.

That was when the female drew her handgun and fired.

A 911 caller described the terrifying event to authorities. “We were sitting at our camp eating breakfast, and this person that’s been coming up and causing problems came up and started demanding money and got up and grabbed, or tried to grab, the female that was at the camp and she pulled out a gun and shot him.”

The dispatcher asked if the woman who fired the shot was still on the scene, and the caller confirmed that she was. “She’s distraught,” the caller explained. She didn’t want to do that.”

Responding officers performed life-saving measures at the scene, but the suspect died from his injuries.

The three people at the camp were detained for questioning in connection with the shooting, but no charges are forthcoming. 

Any loss of life is tragic, but according to all eyewitness accounts the deceased man initiated the violent encounter. The woman who defended herself and her companions undoubtedly feels sadness over the outcome, but she must understand that she was given no choice.

Brandishing a knife and threatening to kill others is an act of violence that may be met with lethal force.
