Maine is one of only 12 states that mandates law-abiding citizens retreat when faced with a violent threat outside of the home. That may change if a group of lawmakers gets their way.
On Monday, legislators held a public hearing to weigh in on a bill aligning the state with most of the country.
That is, that the right to self-defense is sacred and fundamental, and good citizens should not be expected to turn tail and run when confronted by violent criminals.
LD 486 would grant the freedom to use force to defend oneself and one’s family in such a confrontation.
Sponsor Chad Perkins (R) brought the measure to correct the unthinkable decision law-abiding citizens are forced to make by such laws. Defending loved ones should never have to be weighed against possible legal consequences brought by misguided statutes or anti-Second Amendment prosecutors.
Rather than protect the public from violent criminals, Perkins declared that current Maine law accomplishes the opposite result.
“Removal of the duty to retreat is not new, it’s not radical, and it surely is not without precedent,” Perkins explained. “Duty to retreat laws subordinate the liberty interests of the law-abiding person to the wishes of unlawful actors.”
Instead of reacting the way common sense and instinct dictate, potential victims are forced to make a split-second decision to defend themselves or flee. There should not be repercussions for simply fighting back against a violent attack.
Such laws defy logic and reason and are diametrically opposed to this nation’s proud tradition. Critics charge they may also be used to force victims to take specific actions in a criminal confrontation.
For example, a victim could face prosecution if they ignore a command from the suspect and use a weapon to protect themselves. There is undoubtedly no Founding Era precedent to support eradicating the right to armed self-defense.
