Using a firearm to defend against violent criminals is a regular occurrence in 2025. However, even in a clear case of self-defense, the possibility exists that an overzealous prosecutor or misguided laws may endanger the upstanding citizen who simply exercised their Second Amendment rights.

There is now good news for an Idaho man who was caught up in a frightening situation in which he had to use potentially lethal force to protect himself.

A Nampa resident who faced possible felony charges after fatally shooting an attacker outside of his home is off the hook. After an investigation, prosecutors decided that Ryan Fleming lawfully acted in self-defense in the September 29, 2024, incident.

The Canyon County Prosecutor’s Office determined that Kevin Villalobos was intoxicated when he arrived at the Fleming home.

The uninvited intruder escalated the situation quickly when he attacked the resident just outside the front door. Fleming responded by firing a weapon, striking Villalobos and killing him.

Prosecuting Attorney Christopher Boyd revealed that the intended victim’s actions were legal in Idaho, declaring that Fleming “exercised his legal right to self-defense and used necessary force to protect himself and his home.”

Boyd explained, “This was a tragic situation, but Idaho’s self-defense and Stand Your Ground laws are clear. When someone is violently attacked at their home, the law presumes they are acting out of reasonable fear and allows them to use force to protect themselves.”

The prosecutor’s office concluded that the use of force was appropriate and necessary. 

Idaho residents do not face the unreasonable requirement to flee if they are confronted by a violent criminal at their home. This “Stand Your Ground” law protects good citizens if they have reason to believe they face grave danger or a serious threat. 

Unfortunately, the same cannot be said for more than a dozen states without Stand Your Ground laws or Castle Doctrines.
