An alarming attack on a woman in her home unfolded Monday in Louisiana, and despite efforts to deescalate the situation, it was a loaded firearm that may have saved her life.

The St. Tammany Parish Sheriff’s Office reported that what appeared to be a domestic dispute escalated quickly. The suspect, 52-year-old Tyrone Mercadel of Slidell, allegedly kicked in the front door of the residence before attacking the female occupant.

Investigators believe 53-year-old Wayne Mercadal, whose relationship to the suspect is unclear, attempted to persuade the intruder to leave.

That did not work.

The woman then secured a loaded firearm to defend herself with and fired two shots at the alleged attacker. One struck him in the leg, and he immediately thought better of his actions and attempted to get away.

According to reports, as Tyrone Mercadel tried to enter his vehicle and escape, Wayne Mercadal fired shots at his tires.

In all the mayhem, the suspect somehow escaped but was quickly apprehended by responding officers. He was transported to a local hospital for treatment of his gunshot wound, and authorities confirmed that he will be charged with aggravated battery when he is discharged.

In an interesting development, Wayne Mercadal is charged with aggravated criminal damage for firing shots at the escape vehicle. 

Louisiana law is clear. The Castle Doctrine means that the female victim was likely well within her rights to use the firearm to defend herself. However, when the wounded suspect attempted to escape and was no longer a threat, it was unwise to continue to use lethal force. 

The circumstances of the case and the heat of the moment may work in favor of the man who shot at the tires, though he likely has a complicated legal road ahead.

Either way, the woman, who apparently was the intended victim, was fortunate that she had access to a firearm and was not afraid to use it.
