Pennsylvania’s defense against a legal challenge to the state’s contentious law prohibiting concealed carry for ages 18-20 suffered a setback on Monday. A three-judge U.S. Court of Appeals panel for the Third Circuit turned aside the state’s attempt to remand the case against the law.

This week’s welcome action means proceedings against the arbitrary restrictions will move forward in the Appeals Court.

The plaintiffs are the Second Amendment Foundation (SAF) and three young adults who are members of the gun rights organization.

The defendant is Pennsylvania State Police Commissioner Col. Christopher Paris, in his law enforcement capacity.

Alan Gottlieb founded the SAF, and he celebrated the decision in an interview with Breitbart News. “This is a great ruling by the Third Circuit Court of Appeals in the Second Amendment Foundation’s case. The state of Pennsylvania can’t delay the Appeals Court from now hearing our case and making a ruling.”

He added that thousands of young Pennsylvania adults with no criminal background would legally carry weapons to defend themselves and their loved ones without the challenged law.

SAF Executive Director and Counsel Adam Kraut noted earlier this year that the three young plaintiffs are law-abiding citizens who were denied the right to carry firearms in public for self-defense.

Kraut declared that the nation’s history and tradition of gun regulations do not establish the necessary precedent for such a restriction. “A look back at the history reveals young adults between 18 and 20 were fully protected by the Second Amendment at the time of its ratification. Indeed, at the time of the Founding, young adults in this age group were actually required to keep and bear arms.”

The Supreme Court’s Bruen decision and the litmus test established for the constitutionality of gun control laws should have settled this issue two years ago. Unfortunately, anti-Second Amendment forces persist in attempting to strip constitutional rights, forcing groups like the SAF to remain diligent and challenge these statutes in court.
