The effort by Minnesota lawmakers to strip Second Amendment rights from young adults was dealt another severe blow on Wednesday when the Eighth Circuit Court of Appeals refused to rehear the case.
State officials sought relief from the appeals court after U.S. District Court Judge Katherin Menendez struck down the contentious law in March 2023.
In Worth v. Harrington, Menendez ruled that not only do 18-20-year-olds qualify as “the people” under the Bill of Rights, there is no history or tradition of gun regulations in the U.S. barring this age group from keeping and bearing arms.
The Second Amendment Foundation (SAF), along with the Firearm Policy Coalition (FPC) and Minnesota Gun Owners Caucus, brought the case in June 2021 in defense of gun rights.
The plaintiffs were obviously pleased with the outcome. SAF executive vice president Alan Gottlieb celebrated the victory while wondering if the state would attempt to take its case to the Supreme Court.
Gottlieb noted, “We are gratified by the Eighth Circuit’s decision, and now we will see whether Minnesota submits a petition for certiorari to the Supreme Court. For the time being, we have notched another victory in our ongoing effort to win firearms freedom one lawsuit at a time.”
SAF executive director Adam Kraut declared that the rights protected by the Second Amendment are not limited only to adults of a particular age group.
“Certainly young adults fall within the definition of ‘the people’ ever since they’ve been allowed to vote, and generations before that when they were considered part of the militia, and have been accepted into the military,” Kraut observed.
If the state chooses that route, it is unlikely to find a sympathetic high court, and the plaintiffs are to be congratulated for yet another successful defense of Second Amendment rights.
