The fundamental right for law-abiding citizens to exercise armed self-defense in Minnesota suffered a significant blow Thursday.

The House of Representatives rejected a bill to enshrine this freedom into law. Last year, the Minnesota Supreme Court upheld the “duty to retreat” in the face of a violent attack in a controversial 4-2 decision.

Rob Doar, the vice president of the Minnesota Gun Owners Caucus, blasted the 2024 ruling as creating unnecessary liability for crime victims.

“Minnesota is one of the states that does have a duty to retreat,” Doar explained. “But now with this decision, we are literally the only state in the country that requires you to retreat before you even present a force option.”

Residents who are outside their homes must attempt to flee from a dangerous situation before wielding or threatening deadly force. The “Castle Doctrine” protects only those who are within their residence.

State Rep. Matt Bliss (R) introduced the doomed legislation to restore sanity to Minnesota’s legal code. He declared that his measure would establish the right of citizens to defend themselves regardless of where they are when they encounter a violent criminal.

Critics smeared House File 13 as a “shoot first” legislation and compared it to “stand your ground” laws in other states. They further claimed that the bill allows someone to “shoot first and ask questions later” and would “legalize unnecessary violence, increase gun deaths, and deepen disparities in Minnesota. 

They further point to Minnesota’s current standard as sufficient for dealing with a threatening incident.

For an individual not to face legal trouble, they must not have been the aggressor and had to believe that they faced imminent danger of bodily harm. Their fear must be reasonable and, most importantly, they could not have had the ability to escape to avoid the threat.

In other words, Minnesota residents must run away when confronted by someone intent on robbing or harming them.
