President Joe Biden (D) rattled the political landscape last weekend when he issued a blanket pardon for any and all crimes committed by his son Hunter over an expansive 11-year period.

Included in those felony convictions were three charges related to false statements on ATF form 4473, which is mandatory to purchase a weapon legally.

The younger Biden was convicted earlier this year on charges of making a false statement in the purchase of a firearm, possession of a firearm by a person who is an unlawful user of or addicted to a controlled substance, and one count of making a false statement related to information required to be kept by a federal firearms licensed dealer.

The federal form’s question is clear and familiar to anyone purchasing a firearm from a licensed retailer.

“Are you an unlawful user of, or addicted to, marijuana or any depressant, stimulant, narcotic drug, or any other controlled substance? Warning: The use or possession of marijuana remains unlawful under Federal law regardless of whether it has been legalized or decriminalized for medicinal or recreational purposes in the state where you reside.”

Only “yes” or “no” responses are accepted, and the First Son responded negatively despite admitting in his autobiography that he was a drug addict at the time of his weapon purchase.

The 46th president released a statement claiming that Americans are rarely indicted for deceptive practices in acquiring a firearm.

Biden wrote, “Without aggravating factors like use in a crime, multiple purchases or buying a weapon as a straw purchaser, people are almost never brought to trial on felony charges solely for how they filled out a gun form.

It must be noted that the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) spent the last four years going after lawful gun owners and upstanding retailers for the slightest of infractions.

The irony was not lost on Second Amendment Foundation (SAF) founder Alan Gottlieb. The prominent gun rights advocate charged that the blanket pardon is a gross miscarriage of justice and an insult to anyone convicted for falsifying documents related to firearms. 

“This pardon is an affront to all the people who have been convicted and/or served prison time for falsely filling out the same federal form that Hunter Biden did,” Gottlieb declared in a statement to Breitbart News, “especially those who committed a nonviolent crime as a young adult and were told they lost the right to own a gun and had no intention of lying.”

Hunter Biden faced up to 25 years in prison on the gun charges and as much as 17 years for tax evasion.

Gun rights advocates such as Gottlieb were quick to note the two-tiered system of justice related to gun charges. Even the president’s party colleagues denounced the blanket pardon as setting a bad example for the nation.

Colorado Gov. Jared Polis (D), a staunch gun control supporter, expressed his disdain to the Wall Street Journal. He noted that the president “put his family ahead of the country” and established “a bad precedent that could be abused by later presidents.”

Rep. Greg Stanton (D-AZ) also took issue with the elder Biden’s pardoning of his son for gun and tax charges. The congressman wrote on X, “I respect President Biden, but I think he got this one wrong. This wasn’t a politically motivated prosecution. Hunter committed felonies and was convicted by a jury of his peers.”

Outgoing presidents regularly issue pardons before they return to being private citizens. However, a precedent for pardoning one’s own son has now been established, and future prosecutions for misinformation on federal forms—including for the purchase of a firearm—are called into question.
