The tale of a good guy with a gun is as old as the weapons, and a tragic outcome is usually avoided when a person steps up and defends themselves and others. This latest example comes from California, not the normal place you would consider for a case of armed self-defense.
And despite the deadly result of the confrontation, the good news is that the armed citizen will not face charges in the shooting.
This frightening scenario unfolded in a Carmichael apartment over the weekend, according to the Sacramento County Sheriff’s Office. Authorities were called to the scene of a shooting at around 2:00 a.m. Sunday morning.
The male caller reported that he was sleeping in his bedroom when he was attacked by an intruder. The intended victim was able to secure a weapon and fired at his attacker.
Upon arrival, officers found the unidentified offender dead in the home. The investigation quickly uncovered the motivation behind the intrusion, as SCSO Sergeant Amar Gandhi explained to local media.
“The caller reported that a person entered his bedroom and attacked him. In response, he retrieved a firearm and shot the intruder.” A woman who was present in the room identified the attacker as her ex-boyfriend, and Gandhi added that the shooter was legally qualified in California to be armed.
CBS News 13 interviewed Sacramento attorney Michael Wise on the circumstances of the shooting. He made clear that the current boyfriend was legally justified in defending himself and his girlfriend from the intruder.
“The new boyfriend had a gun, legally obtained and registered to him, and shot the ex-boyfriend. If this gentleman was presented with a lethal threat that he did not trigger in any way, then he’s entitled to defend himself and kill that intruder.”
Wise added that, even in California, resorting to deadly force is justified in such a case.
That is good news for the couple who were targeted, and also for other residents who face a potential life-or-death situation.
