Custodial disputes involving minor children can be tricky, and a recent confrontation in Colorado which should have been simple instead exploded into a case of armed self-defense.

And the results were fatal.

The Colorado Bureau of Investigation (CBI) believes a custody exchange in a store parking lot Friday night went sideways and resulted in the death of the biological father.

The incident unfolded around 5:30 p.m. when the father, identified as 28-year-old Luis Morales, met the child’s mother and her 29-year-old boyfriend for the exchange. Investigators reported that Morales threatened the boyfriend during an argument that became a physical fight.

The boyfriend apparently defended himself by producing a weapon and firing a single shot.

First responders treated Morales at the scene, and he was transported to an area hospital, where he died.

Authorities reported that the unidentified boyfriend remained at the parking lot and cooperated with the investigation. No charges have been filed against him, and the boyfriend was released from custody as the probe into the deadly incident continues.

The CBI released a statement concerning the incident. “The suspect has been forthcoming, and we are working closely with the Woodland Park Police Department and the 4th Judicial District Attorney’s Office to ensure a thorough and accurate investigation.”

Domestic disputes are a tricky business, and the animosity between parents who are no longer in a relationship can spill over into emotional confrontations. It is not clear whether the biological father was armed, and Colorado law may not work in favor of the boyfriend. 

Many states protect the rights of law-abiding citizens to stand firm in the face of a violent threat and not be burdened with the duty to retreat, but Colorado is not one of them.
