Colorado’s steady drumbeat of anti-Second Amendment legislation continued this week, though the latest was significantly altered after hours of heated debate.
The Colorado Senate approved SB 25-3 late Friday night. This bill would ban the sale or purchase of a wide array of popular semi-automatic firearms with detachable magazines.
However, the measure underwent profound changes on its way to approval in the upper chamber.
The state already bans standard-capacity magazines, which hold more than 15 rounds. This bill took the prohibition a significant step forward.
With the compromise, Colorado residents will continue to be able to acquire these common weapons if they have completed a safety and training course and jumped through other mandated hoops.
State Sen. Byron Pelton (R) forcefully argued against this measure. “This will actually create a black market for people to go into the black market to buy these rifles, and then the other thing this will do is put gun stores out of business.”
Pelton declared that the weapons targeted by lawmakers are the most popular in small gun shops across Colorado.
Of course, this is a wholly unnecessary infringement on the right to keep and bear arms. However, it does signal that the battle for gun rights in the Western state is not over.
Lawmakers approved the change to gain favor with Gov. Jared Polis (D). Though hardly a gun rights advocate, the governor has at times been reluctant to sign sweeping gun control measures.
The original bill would have prohibited the sale, purchase, or transfer of firearms with a detachable magazine. This ban would have affected most common sporting rifles and handguns.
The new process approved by the Senate is a compromise but hardly perfect. Purchasers must be approved by their county sheriff and have completed a Colorado Parks and Wildlife hunter safety course before taking a four-hour safety course.
If they do not already have the hunter safety course certification, the applicant must complete a 12-hour in-person course over two days and pass an exam.
