A long-overdue push to safeguard veterans’ gun rights is underway in Congress. The Veterans Second Amendment Protection Act has been reintroduced in both the Senate and House, and hopes are high that the political shift in Washington will allow it to pass and become law.

Rep. Mike Bost (R-IL) and Sen. Jerry Moran (R-KS) are the Chairmen of the House and Senate Committees on Veterans’ Affairs, respectively. Along with Sen. John Kennedy (R-LA), these influential legislators want to end decades of shameful federal policy.

A policy that meant veterans losing their Second Amendment rights simply for needed assistance with financial affairs. The American Legion noted that between 1998 and 2020, the Veterans Administration made over a quarter of a million submissions to NICS.

Bost charged that these heroes are treated as second-class citizens for seeking “help managing their books.”

This, the congressman declared, must stop.

“Without a permanent fix in place, VA bureaucrats can continue to strip veterans with fiduciaries of their Second Amendment rights with no court ruling in place that they are a danger to themselves or others,” Bost said.

Many times, veterans are reluctant to seek assistance for everything from bookkeeping to mental health issues out of a justified fear of losing their constitutional freedoms. Sen. Moran wants to fix this injustice.

“Veterans should never be forced to choose between receiving assistance from VA to manage their benefits and their fundamental Second Amendment rights,” he said. “Our nation should be encouraging veterans to utilize VA services, not discouraging them by denying them due process.”

The VA practice of submitting these names to NICS was temporarily halted last year, but that prohibition ended. 

The American Legion charged that “a constitutionally enumerated right” is being torn away from the most deserving “by bureaucratic determination rather than through due process.”

The advocacy group supports substantial clarification by the VA of what constitutes “incompetency.” The Legion called addressing this injustice a matter “of utmost importance.”
