The Department of Justice (DOJ) will be under new leadership next month, but that’s hardly stopping outgoing officials from piling on new gun control regulations.

The DOJ recently introduced two rules under the auspices of the so-called Bipartisan Safer Communities Act (BSCA).

As a reminder, a group of ordinarily reliable Second Amendment defenders jumped on the bandwagon with anti-gun forces after the Uvalde massacre to pass this controversial legislation. This marked the first significant new federal firearm regulations since the ill-fated “assault weapons” ban of the 1990s. 

Not only were states pushed to adopt so-called “red flag” laws, but the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) was encouraged to pursue even more extreme gun control measures.

A central figure in this legal atrocity was Sen. John Cornyn (R-TX). He drew particular ire from Second Amendment advocates for his leading role in pushing BSCA through, and the gun rights community has not forgotten. 

Now, the DOJ is using BSCA as an excuse to levy more new limitations on gun owners.

The recent federal action has two components. This month, the DOJ announced a proposal to allow federal firearm licensees (FFLs) to use the National Instant Criminal Background Check System (NICS) to conduct background checks on gun store employees.

These checks are currently limited to those seeking a firearm transfer through an FFL.

The second DOJ initiative would mandate enhanced criminal background checks on potential weapon purchasers under 21. The FBI would contact state and local agencies and gather juvenile records concerning criminal activities and mental health.

Some states already prohibit such transfers of information concerning minors.

It is noteworthy that the BSCA passed on the promise of preventing another Uvalde from happening. However, none of these proposed changes would have stopped that fateful Texas shooting and are merely an expansion of gun control laws without congressional approval.

And that is unconstitutional.
