The battle to protect Second Amendment rights in Illinois is far from over, but supporters suffered a setback Thursday before the Seventh Circuit Court of Appeals. The body stayed a lower court decision to abolish the state’s controversial ban on so-called “assault weapons.”

District Judge Stephen McGlynn ruled last month that the poorly named Protect Illinois Communities Act violated the Second and 14th Amendments. 

Anti-gun forces in the state appealed his decision, and the Seventh Circuit court determination means the ban will remain in place while the appeal continues.

The act was signed into law by Gov. J.B. Pritzker (D) last year in a whirlwind of criticism from defenders of gun rights. It included a blanket prohibition of popular sporting rifles and standard capacity magazines.

The law further mandated that current owners register these banned items with the Illinois State Police.

Richard Pearson is the executive director of the Illinois State Rifle Association (ISRA). He expressed his disappointment with the appeals court decision but said the case remains solid.

“We think we have a strong case. We’ve built the evidence file,” Pearson explained. “There’s been over 10,000 pages of documents filed and testimony filed, so I think we have a very good case.”

The state reaction, as could be expected, was far different. 

Illinois Attorney General Kwame Raoul (D) issued a statement praising the appeals court, claiming the Protect Illinois Communities Act keeps citizens safe.

The plaintiffs may file an emergency appeal with the U.S. Supreme Court, but that approach has yet to succeed in Second Amendment-related cases. 

The good news is that, with multiple anti-gun states prohibiting semi-automatic weapons and a bevy of legal challenges against them, there is bound to be a case that reaches the high court. At that point, there is a strong possibility that justice will prevail for defenders of gun rights.
