Anti-gunners frequently attack the rights of young adults to keep and bear arms, and that freedom suffered another setback in Colorado on Tuesday.

The Rocky Mountain Gun Owners v. Polis case went before the 10th Circuit Court of Appeals, and the outcome was unfavorable for the Second Amendment. The court ruled that the state law prohibiting gun sales to young adults 18-20 years of age is constitutional and may proceed.

Proponents of gun rights won a reprieve last year when a federal judge, just before the new law was to take effect, blocked its enforcement with a temporary injunction.

The judge responded to a legal challenge from the advocacy group and two citizens who declared they were denied their right to purchase a firearm for self-defense. 

The contentious law languished in the system before last week’s ruling by the three-judge panel. Interestingly, much of the basis of their reasoning appeared to be only that other states successfully enacted similar restrictions.

As any logical thinker will confirm, the mere fact that it passed scrutiny elsewhere does not remove the duty to judge the law on its constitutional merits.


The Second Amendment grants the right to keep and bear arms to “the people,” and this designation historically included those 18-20. This age group can serve in the armed forces and lose their lives for the nation, vote in every election and enter into contracts.

However, according to the 10th Circuit, they must be more mature to be protected by Second Amendment rights.

Judge Richard Federico wrote that “no one is reasonably arguing that 8-year-olds should be allowed to purchase guns.” That is true, and neither do they vote or serve in the military. 

The court relied on the flimsiest logic for denying fundamental constitutional rights to a significant adult population group. The fact that multiple states enacted such a prohibition just makes it ripe for Supreme Court intervention.
