The 9th Circuit Court of Appeals ruled unanimously on Tuesday that California’s blanket ban on gun shows and weapons sales on any state property is constitutional.
The 3-0 decision upheld two laws that opponents charged violated the Second Amendment rights of firearm sellers and purchasers. In October, a federal judge ruled the statutes did not withstand constitutional muster, but that decision is now set aside.
U.S. District Judge Mark Holcomb then sided with the plaintiffs in determining that the laws infringed on their right to conduct transactions that may be legally consummated elsewhere. He further ruled that the statutes interfered with First Amendment commercial speech rights.
That decision faltered with the court of appeals.
State Sen. Dave Min (D), a noted anti-gun zealot, spawned both measures. The first took effect over two years ago before it was temporarily overturned and banned gun shows at the traditional Orange County Fair.
The second built on the success of anti-gunners and extended the prohibition to all state-owned property and facilities.
Notable Second Amendment opponents such as California Attorney General Rob Bonta (D) celebrated the court ruling. “Guns should not be sold on property owned by the state, it is that simple. This is another victory in the battle against gun violence in our state and country.”
But in the quest to never let facts get in the way of a good argument, Bonta and the state did not present specific evidence that decades of gun shows at fairgrounds contributed one iota to the criminal violence plaguing the state.
Instead of addressing the perpetrators of illegal activity, these laws are yet more window dressing designed to appeal to gun control advocates. No matter what misguided politicians proclaim, there will almost certainly be no effect on public safety in California.
