Maryland’s sweeping attempts to eradicate public firearms carry suffered a significant setback last week in federal court. U.S. District Judge George L. Russell III found several facets of the state’s prohibition on weapons carry unconstitutional.

The prohibitions on possessing a firearm in establishments that sell alcohol, private property or buildings without the owner’s expressed consent and within 1,000 feet of a public demonstration were tossed out by Russell.

He declared these three laws to be “permanently enjoined.”

The Firearms Policy Coalition (FPC) led the charge against the state’s latest round of attacks on Second Amendment freedoms. And the outcome of Novotny v. Moore is a cause for celebration for the gun rights organization.

FPC President Brandon Combs declared, “We are pleased the court blocked some of Maryland’s unconstitutional restrictions on the right to carry firearms in public. But we have more work to do and are committed to finishing the job.”

Combs insisted that the FPC and its allies will continue the fight for law-abiding Americans.

Adam Kraut, executive director of the Second Amendment Foundation (SAF), was pleased with the success of the joint effort with the FPC.

He explained, “Such a provision flies in the face of this nation’s history and tradition. Of course, we will examine the court’s opinion and weigh our options for appeal to continue to challenge other provisions we believe are unconstitutional.”

Maryland’s so-called Gun Safety Act of 2023 sought to greatly expand the lengthy list of “sensitive places” where weapons were not allowed. Several other locations, including stadiums, government buildings, state parks, healthcare facilities and public transit locations are still off-limits for carry rights.

These restrictions will likely be further challenged in the Fourth Circuit Court of Appeals. Kudos to the FPC, SAF and all who supported this successful challenge to Maryland’s most recent overreach.
