Another day, another state moves to circumvent federal law shielding the gun industry from being hammered by frivolous lawsuits seeking to drive it into the ground.
This time it is Maryland, with an assist from the City of Baltimore, attempting to bypass the Protection of Lawful Commerce in Arms Act (PLCAA).
The PLCAA is a two-decade-old federal law established to protect the weapons industry from ridiculous lawfare intended to bankrupt gunmakers.
Unfortunately, this crystal-clear statute does not deter anti-gun forces in city and state governments from attempting to weaponize taxpayer resources to deny those very same citizens their Second Amendment rights.
Now, the National Shooting Sports Foundation (NSSF) wants a preliminary injunction against the state’s new Gun Industry Accountability Act, or House Bill 947. This measure is an outgrowth of a previous legal action that the PLCAA should prohibit.
Maryland Attorney General Anthony Brown and Baltimore officials sued GLOCK, Inc. over criminal misuse of the company’s products.
Lawbreakers obtain “machine gun conversion devices,” or “Glock switches,” and illegally modify perfectly legal weapons. Somehow, in the eyes of Maryland officials, this makes GLOCK Inc. liable.
By contrast, automakers are hardly responsible when a shade tree mechanic alters their vehicle into something that is not legal to drive on the street but does so anyway.
NSSF Senior Vice President and General Counsel Lawrence G. Keane explained that the PLCAA expressly forbids the type of action Maryland is foolishly undertaking.
“The PLCAA prohibits the type of lawsuit brought by Maryland Attorney General Brown against GLOCK, Inc,” Keane declared. “Attorney General Brown is targeting perfectly legal commerce. Maryland’s law that seeks to impose a gun control agenda through litigation not only runs afoul of the PLCAA, but it also violates the First Amendment by limiting protected commercial free speech, the Commerce Clause, and the Second Amendment.”
The success of the NSSF lawsuit is highly significant for Maryland gun enthusiasts, as there is no doubt that the state will use HB 947 as a club to pummel their right to keep and bear arms.
