It did not take long for the first legal challenge to Massachusetts’ controversial new gun control package to be filed.
Last week, Gov. Maura Healey (D) signed H. 4885 into law to much fanfare from the state’s powerful anti-gun lobby. The massive 116-page measure enacted sweeping bans on popular sporting rifles, established new magazine restrictions, mandated registration of all firearms, prohibited so-called “ghost guns,” implemented egregious new training requirements and more.
Now, the first of what will undoubtedly be a wave of litigation to protect the rights of law-abiding citizens has been filed.
Commonwealth 2A specifically targeted the state’s sweeping licensing and training mandates that are already required even though they are far from ready. The law ordered the head of the Massachusetts State Police to develop and implement an entirely new array of hoops for anyone seeking a License to Carry to jump through.
The problem is that the mandate exists, and the hoops do not.
This means there is currently no way for a Massachusetts resident to obtain a carry permit.
The National Rifle Association (NRA) also weighed in on the controversy, calling the new law “one of the most egregious and freedom-restricting” in the history of the state.
The director of licensing for the State Police emailed firearm instructors to inform them that they must follow new regulations “after August 1, 2024,” and that all classes “that do not adhere to the updated curriculum will not be sufficient for the issuance of an LTC.”
The missive notified instructors to disclose this information to potential students.
This means that today, in Massachusetts, it is impossible for a person to apply for or receive an LTC if they do not already have a state firearms license. No required courses may be taught since the curriculum has not been established and is not expected until late October.
They say the first step to solving a problem is admitting there is one.
