Florida’s attempt to reverse hastily drawn-up gun control laws following the 2018 Parkland massacre hit a snag last week. The 11th Circuit U.S. Court of Appeals upheld the state statute prohibiting the purchase of long guns by young adults under 21.

That ruling, however, may be short-lived.

Florida Attorney General James Uthmeier quickly announced that if the National Rifle Association (NRA) seeks to appeal the case to the U.S. Supreme Court, the state will not defend the law.

Uthmeier posted on X, “Upon assuming office, I tasked my staff with reviewing Florida’s underlying law and whether it was consistent with the Second Amendment. Notwithstanding CA11’s opinion today, I believe restricting the right of law-abiding adults to purchase firearms is unconstitutional.”

The AG noted that the 5th Circuit recently reached the same conclusion, which means the contested issue could go to the high court.

“If the NRA decides to seek further review at SCOTUS,” Uthmeier declared, “I am directing my office not to defend this law. Men and women old enough to fight and die for our country should be able to purchase firearms to defend themselves and their families.”

In the January 5th Circuit ruling, the three-judge panel wrote, “Ultimately, the text of the Second Amendment includes eighteen-to-twenty-year-old individuals among ‘the people’ whose right to keep and bear arms is protected.”

The courts once upheld these arbitrary restrictions, but that changed with 2022’s landmark Bruen decision by SCOTUS that leveled the gun control playing field.

Now, these controversial laws must have solid precedent in the nation’s history and tradition of firearm regulation. In this light, more courts now find constitutional fault with such limits on young adults.

Recent conflicting rulings, including last week’s in Florida, may well lead to this issue being heard by the Supreme Court.
