Just in time to deliver a Christmas gift to Louisiana gun enthusiasts, the Firearms Policy Coalition (FPC) announced a new lawsuit against the state.

The Second Amendment advocacy organization filed Mate v. Westcott the day before Christmas Eve. The case is based on the Bayou State’s surprising ban on out-of-state visitors carrying weapons, even if fully licensed.

The complaint takes the typically Second Amendment-friendly state to task for ignoring Supreme Court guidance with its ban. There is no firm historical precedent for such an infringement.

According to the lawsuit, “Closing off nonresidents’ ability to obtain a carry license substantially infringes their constitutionally protected right to carry a firearm in public for self-defense. There is no well-established and representative historical tradition of restricting the ability to bear arms based on residency.”

In the monumental Bruen decision of 2022, the high court ruled that modern gun control laws must be rooted in the nation’s history and tradition.

FPC President Brandon Combs declared that lines on a map do not determine law-abiding citizens’ rights within the U.S. “Peaceable people have a constitutionally protected right to carry firearms throughout the United States. Second Amendment-protected rights do not end at a state’s border. This case is an important step toward achieving our goal of restoring the right to bear arms everywhere.”

There is renewed hope in the shooting community for the National Concealed Carry Reciprocity Act. With the federal government undergoing sweeping changes, states may soon recognize non-residents’ carry rights.

Louisiana passed constitutional carry in July 2024 but remarkably did not allow those from other states to apply for a permit.

This led directly to last week’s filing from the FPC. The gun rights organization hopes that short of new federal action, Louisiana will join other states in fully honoring Second Amendment rights for its visitors.
