Georgia leaders are stepping up to stop a city’s attempt to restrict Second Amendment rights despite a clear state law prohibiting such actions.
The Peach State is one of many that wisely prevents local municipalities from imposing gun control measures on law-abiding citizens. This protects the public from zealous anti-gunners and prevents an unworkable patchwork quilt of laws that the people would be forced to navigate.
However, the coastal city of Savannah attempted to circumvent the state’s preemption law. Leaders in the tourist destination decided to impose fines and possible jail time for those who leave firearms in unlocked cars.
House Majority Leader Chuck Efstration (R) declared that such local ordinances cannot stand. “Municipalities are a creation of this body. If they are circumventing the laws of this state, it needs to be corrected.”
The city’s defiance of the preemption law was challenged last year, but Chatham County Superior Court Judge Benjamin Karpf tossed it out on technical grounds. He ruled that the plaintiff did not have legal standing to challenge the Savannah law, not that the statute passed judicial muster.
State legislators are now looking to counter this local action.
Senate Bill 204 would reestablish the preeminence of laws passed by the Georgia government and prevent Savannah and other municipalities from implementing their own gun control.
Rep. Anne Allen Westbrook (D) defended the city’s move, claiming that all leaders are asking of residents and visitors is that they “lock their cars.”
But Rep. Alan Powell, a SB 204 sponsor, countered that Savannah’s leadership is not going after the true culprits—those who steal firearms.
“Why would a city pass a law to penalize someone who is a victim of a crime?” Powell questioned. “That’s not justice.”
SB 204 passed the state House on a party-line vote, meaning it will move back to the Senate before likely heading to the governor’s desk for his signature.
