Local governments in most states are not free to infringe on Second Amendment rights thanks to preemption laws. While this hierarchy of authority is logical and overwhelmingly constitutional, there are still attempts by anti-gunners in city and county governments to eradicate the right to keep and bear arms.
With this growing concern in mind, Georgia lawmakers recently acted to strengthen the state’s preemption law significantly.
The statute expressly forbids local entities from regulating “in any manner” gun shows, “possession, ownership, transport, carrying, transfer, sale, purchase, licensing, or registration of firearms, firearm dealers or dealers of other weapons, or dealers in components of firearms or other weapons.”
Rather comprehensive on the surface, but there’s a catch.
According to state Sen. Colton Moore (R), the author of the new bill, the current law fines government entities that break the law a paltry $100.
SB-163, which cleared the Senate on a 33-23 party-line vote, jacked up the fine to $50,000.
Moore told reporters that the current law “creates a lot of violent situations in a lot of these cities and ultimately, the Second Amendment is there to protect law-abiding citizens from things like violent crime.”
The lawmaker added that local governments must stop impeding constitutional rights.
“For too long, Georgia mayors have gotten away with breaking our preemption law and facing zero consequences,” Moore declared. “If our Attorney General won’t prosecute these lawbreakers and end this, it’s time we gave law-abiding Georgians the tools to do it themselves.”
Supporters of strengthening the preemption law point to Savannah’s example. The coastal city bucked the state government last year when it unilaterally passed a “safe storage” law governing how gun owners keep weapons in their personal vehicles.
If it clears the House and is signed by Gov. Brian Kemp (R), the new law specifically includes gun storage on the list of Second Amendment-related issues that the state alone decides.
