Even as anti-gun forces attempt to gain the upper hand in Pennsylvania, a push by defenders of constitutional rights scored a clear victory last week in federal court.

The ruling came in the U.S. District Court for the Middle District of Pennsylvania. Judge Christopher C. Conner granted a summary judgment to the Second Amendment Foundation (SAF) and other plaintiffs in their fight to preserve individual rights.

Conner found the state statute prohibiting carrying a firearm in a motor vehicle without a license unconstitutional. He further decided that the firearm ban during a state of emergency violated the Constitution and blocked state officials from enforcing this law.

A third gun control issue was decided in favor of the Pennsylvania State Police, but that was only due to the plaintiffs’ lack of standing. 

The court noted that the plaintiffs may file an amended complaint when they have proper standing.

After the court’s decisions, SAF Executive Director Adam Kraut took a well-deserved victory lap. “Each victory takes us a step further in our efforts to win firearms freedoms one lawsuit at a time,” he noted. “We will evaluate the judge’s ruling and determine our next course of action.”

Kraut added that the SAF is satisfied with Conner’s decision upholding Pennsylvanians’ right to possess a firearm in a vehicle without a state license.

Not every court battle over gun rights is as clear of a win as this week’s Keystone State decision. It remains critically important that all who cherish their Second Amendment freedoms support those groups who take the fight directly to powerful lawmakers who would erase those hard-earned rights. 

But Pennsylvania’s conclusion is certainly a cause for celebration, and the plaintiffs are to be commended for their hard work in defending the state’s law-abiding citizens. And now, attention may be turned to the next battle in the long struggle to maintain gun rights.
