The current administration is moving to streamline the process for returning Second Amendment rights to former convicts. 

On Wednesday, the Department of Justice (DOJ) posted an interim final rule that would move the restoration of gun freedoms away from the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) and to Attorney General Pam Bondi’s (R) desk.

The AG declared that this power was shifted because Congress blocked funding for the restoration process over three decades ago. There has been precious little advancement on this issue since.

That stagnation, however, is changing. Recent court decisions reopened the issue of non-violent felons regaining their gun rights, and there are signs that the status quo may be dramatically altered.

This is due primarily to 2022’s landmark Supreme Court decision, New York Rifle & Pistol Association v. Bruen. The high court determined that modern gun control regulations must align with the country’s history and tradition of firearm laws.

If there is no precedent found in the Founding Era, the modern law must be null and void.

In December, the 3rd U.S. Circuit Court of Appeals ruled a Pennsylvania man convicted of food stamp fraud three decades ago should have his firearm rights restored. The court previously upheld the case of Bryan Range, but the DOJ appealed the determination to the U.S. Supreme Court.

Justices sent the case back to Philadelphia for the appeals court to reconsider its finding in Range’s favor.

Current federal law prohibits any individual with a felony or misdemeanor domestic violence conviction from having firearms or ammunition. AG Bondi did not specify what potential qualifications would be for the person seeking to restore Second Amendment privileges.

Despite the lack of specifics, it is encouraging that the DOJ is tackling the process of restoring Second Amendment rights. Non-violent offenders should not suffer through a lifetime gun ban.
