Second Amendment advocates have long held that young adults are part of “the people” as designated in the Bill of Rights. However, the freedom to keep and bear arms is systematically and arbitrarily denied to a large portion of the U.S. population.

The National Rifle Association (NRA), Firearms Policy Coalition (FPC), Second Amendment Foundation (SAF), Gun Owners of America (GOA), and other groups joined forces against Massachusetts. 

The state enacted H.B. 4885 last July, denying gun rights to adults under 21. Anti-gunners successfully prohibited this age group from possession and carry of handguns and semi-automatic weapons.

NRA-ILA Executive Director John Commerford blasted the state’s attack on constitutional freedoms.

“Massachusetts’s new gun control law is one of the most severe attacks on the right to keep and bear arms in our nation’s history,” Commerford declared. “Vindicating the rights of young adults is just our first step toward dismantling this unconstitutional law.”

Adam Kraut, the SAF executive director, argued that young adults clearly are covered by Second Amendment protections.

Despite this, “the State has opted to affirmatively treat them as if they have less rights. An honest look at our nation’s history and tradition will only yield one result, that is, this law is blatantly unconstitutional.”

The Bay State attempted to circumvent the Second Amendment through a twist in the law.

Adults under 21 may obtain a firearm identification card. However, that alone does not render the right to purchase, possess, or transfer handguns or semi-automatic weapons.

To exercise these freedoms, the individual must acquire a license to carry. By law, that is denied to adults under 21. 


The plaintiffs will argue that the Heller decision of 2008 affirmed the right of adults to possess “common” weapons. These include handguns and semi-automatic firearms, the very same guns denied to young adults by Massachusetts.
