Hawaii legislators moved last week to ban law-abiding young adults aged 18-20 from purchasing or possessing ammunition in the latest move by state officials to suppress Second Amendment rights.
SB2845 went to Gov. Josh Green’s (D) desk, where he signed it into law. This is only the latest in a series of state acts intended to impede the right to keep and bear arms.
The bill reads: “No person shall intentionally, knowingly, or recklessly sell, offer to sell, distribute or otherwise transfer ammunition for any firearm to any person who is under the age of twenty-one.” There are certain limited exceptions that include when a person “is actively engaged in hunting or target shooting or going to or from the place of hunting or target shooting.”
However, in these cases the individual is required to be accompanied by an adult 21 or over.
Retailers must validate the age of an ammunition purchaser through a government-issued ID. Along with banning the sale of ammunition to a young adult 18-21, those in this age group are also prohibited from owning, possessing or controlling ammo.
The law took effect immediately and was one of a package of 17 so-called “public safety” measures that were signed.
State lawmakers’ action blatantly ignores the test mandated by the Supreme Court in the 2022 Bruen decision. Gun control laws must be rooted in the history and tradition of the nation’s firearm regulations, and clearly, this new statute is not aligned with the Founding Era.
A few outspoken lawmakers stood against the ban, as did the Hawaii Office of the Public Defender. Officials noted that the prohibition bars young adults from possessing ammunition even for self-defense purposes.
“This ban runs afoul with the Supreme Court’s decisions about the Second Amendment, making it ripe for a challenge by the defense bar if prosecutors intend on using the statute…in the civil arena.”
