Kentucky is generally a reliable state for defending Second Amendment rights. However, a legislative push for the new year is raising eyebrows and stirring debate on lawmakers’ motives.

State Rep. Kim Banta (R) insists that the bill to make parents responsible for their minor children’s actions in the event of a gun crime where a firearm is discharged is not new gun control.

Instead, it is to instill accountability for those who should be aware of what their kids are doing.

“The most important thing is that I am absolutely not trying to stop gun sales or enact gun control,” Banta told Fox News.

Rather, she explained that her proposal is based on laws that hold parents responsible for motor vehicle accidents and specific criminal acts by their underage children.

Banta added, “I’m simply trying to make parents aware that whether it is driving a car or doing anything else their child does, they need to know what they’re doing, and they need to exercise caution.”

Her bill imposes the burden of civil damages from injuries to another person onto the parents. This is similar to Kentucky’s existing car crash law, which holds fathers and mothers liable for compensation to those hurt when their children wreck a vehicle.

If the bill becomes law, parental liability would kick in if the adult allowed the child to have the firearm, knew of previous criminal acts, or believed the son or daughter had violent tendencies.

Banta cited a recent case involving teenagers and a shooting. Several 15-year-olds were involved in an argument, and of course, it should have ended there.

But one went home and got a loaded weapon before returning and shooting two of the other teens. 

Banta argued that a 15-year-old lacks the mental capacity to make rush judgments that adults are capable of when angry. This means that having a gun is “different” from having a weapon in such times.

Her bill is expected to be presented in the 2025 legislative session.
