If one member of Congress gets his way, the Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF) will be relegated to the dustbin of history.

Rep. Eric Burlison (R-MO) declared his intention last week to sweep the controversial agency aside through legislation introduced last year by then-Rep. Matt Gaetz. 

In a video posted on X, Burlison announced, “In January, I will be filing the bill that Matt Gaetz sponsored to abolish the ATF. Why? Because we’re fighting for you.”

The Abolish the ATF Act is, according to the congressman, in response to the “big government overreach” carried out by the regulatory agency.

The congressman added, “The ATF has been a disaster for the American people and our God-given Second Amendment rights. It should absolutely be abolished.” Burlison asserted that the states are better equipped to handle matters concerning the Second Amendment.

In 2023, Gaetz’s measure was co-sponsored by Burlison and nine other representatives.

The ATF has come under increasing fire in recent years as critics charged the agency was weaponized to carry out a gun control agenda. Several bureaucratic actions were scrutinized as going far beyond the authority bestowed on the agency by Congress.

One such example is the prohibition of pistol braces as firearm accessories. The ATF attempted to redefine the National Firearms Act of 1934 to implement the ban in 2023.

That controversial action was overturned in U.S. District Court this year.

Subsequently, the ATF is frequently sued by state prosecutors determined to ward off infringements on constitutional rights. The agency was established in 1972 under the Nixon administration within the Treasury Department to take over duties formerly carried out by the IRS.

It currently falls under the Justice Department’s umbrella. It is charged with enforcing federal laws related to firearms and other areas and creating new rules that theoretically follow congressional direction and the Constitution.
