Missouri gun enthusiasts may rest assured that a committed group of lawmakers safeguards their Second Amendment rights. And while not everything these legislators attempt passes judicial scrutiny, they never appear to waver.

Take last week, when the lower chamber overwhelmingly approved House Bill 328, which significantly expanded concealed carry rights, on a 106-45 vote.

The proposal would legalize concealed carry on public transportation, a right currently not afforded to residents even with valid concealed carry permits. Further, the minimum age for acquiring a concealed carry permit would be lowered from 19 to 18.

HB 328 sponsor Rep. Tim Taylor (R) argued that current law strips Second Amendment rights from law-abiding citizens simply because they choose to take the bus or train. 

“It’s about time that we allow those people who use public transportation to exercise the same rights as everyone else in our state,” Taylor declared.

Currently, Missouri law imposes a Class D felony for “possession and concealment of a dangerous or deadly weapon” for a person carrying a concealed firearm on public transit.

The proposal confirms the current concealed carry permit process, including age, residency, and background check requirements.

Missouri law presently allows 18-year-olds who serve in the military to acquire a concealed carry permit. HB 328 would expand that right to all 18-year-olds, not just those enlisted in the armed forces. 

One critic, House Minority Leader Ashley Aune (D), blasted the proposal as dangerous for the youth of Missouri. “This means that high school kids could legally carry concealed weapons,” she charged. “What could go wrong with that?”

A similar bill stalled in the Missouri House in 2024. HB 328 now moves to the state Senate, where there will undoubtedly be lively debate on the merits of preserving Second Amendment rights against what critics will charge are public safety issues.
