The hodgepodge of states recognizing Second Amendment rights that border those that do not could end if several lawmakers have their way. 

The right to constitutional carry will be the law of the land if the “National Constitutional Carry Act” is passed through the new Congress and signed in the Oval Office.

Rep. Thomas Massie (R-KY) announced the important gun rights legislation in a press release. The legislation would require states to permit public carry for anyone eligible to have weapons within their borders. 

“I am fortunate to live in a state where people are free to exercise their right to keep and bear arms without begging the government or paying a fee,” Massie explained. “Unfortunately, not every American enjoys the same right to carry firearms in public because some states and localities infringe upon this right through a variety of criminal, civil, and regulatory penalties.”

The proposed legislation has two key provisions

State and local governments would be prohibited from imposing criminal or civil penalties on anyone legally eligible to possess a firearm who carries in public settings.

And any state or local laws, regulations, or restrictions interfering with the right to be armed in public would be nullified.

Massie emphasized that the bill upholds the Founding Fathers’ intent when they created the Second Amendment “to ensure the security of a free state.”

Locations where screening for guns is conducted under state law would be exempt, and private property owners would continue to be able to ban weapons at their locations.

A similar bill stalled in Congress last year, but there is a new balance of power in the Senate and a new Executive Branch that may look more favorably on constitutional carry.

Massie drew criticism from anti-gunners in 2021 over a widely viewed Christmas photo in which every member of his family brandished a firearm. The caption asked Santa to “please bring ammo.”
