It’s the season to watch the schemes that anti-gun state legislators concoct, and there were positive results out of New Mexico’s session that ended Saturday.
Sort of.
Despite multiple bills decidedly antagonistic to the Second Amendment being considered, none are on their way to Gov. Michelle Lujan Grisham’s (D) desk. Lawmakers went home without passing a pair of controversial measures sought by gun rights opponents.
One, SB 318, was another state effort to declaw the Protection of Lawful Commerce in Arms Act (PLCAA). This two-decade-old federal statute safeguards the weapons industry against frivolous legal attacks by state and local governments with deep taxpayer-funded pockets.
The second, SB 279, would have prohibited the manufacture and sale of most popular semi-automatic sporting rifles in New Mexico. And while there was a carveout for those who already own these weapons, there was an egregious catch.
The state would collect data on existing firearms from gun owners. Thus, a registry would be enacted.
While the failure of these measures is good news for New Mexico citizens, it is not time to celebrate. Grisham emphatically proved in late 2023 that she is not above using an executive order to attempt to eradicate gun rights.
Even worse, the New Mexico Supreme Court last month sided with the embattled politician’s declaration of a “public health emergency” to ban the lawful carry of weapons in certain parts of the state.
The National Rifle Association (NRA) and other Second Amendment backers brought the suit. The plaintiffs argued that the governor exceeded her authority in issuing the ban on carrying firearms in public, but the high court decided that her actions were permitted by New Mexico’s Public Health Emergency Response Act.
This could embolden Grisham and her anti-gun allies to seek further restrictions through executive order, and gun rights advocates will watch her actions closely.
