Two significant bills that would profoundly affect gun rights in the United States advanced in Congress last week, and the National Rifle Association (NRA) strongly supports their passage.

John Commerford is the executive director of the advocacy organization’s legislative and political arm. He told Fox News Digital that one of the measures currently being considered would become the “most monumental” victory for gun rights in the past two decades.

Second Amendment supporters have long decried the patchwork quilt of states that do and do not recognize constitutional carry rights.

It is painfully easy for an individual to go from a law-abiding citizen to a criminal simply by traveling to another state. HR 38, the Constitutional Carry Reciprocity Act, seeks to fix this legal flaw. 

President Donald Trump indicated that he would sign the bill into law if it reached his desk.

The measure’s language is clear. A person “who carries or possesses a concealed handgun in accordance with [the law] may not be arrested or otherwise detained for violation of any law or any rule or regulation of a State or any political subdivision thereof related to the possession, transportation, or carrying of firearms unless there is probably cause” for law enforcement to believe otherwise.

Good citizens would simply produce the concealed carry permit issued by their home state to enjoy constitutional carry rights nationwide.

The measure declares, “Presentation of facially valid documents as specified in subsection is prima facie evidence that the individual has a license or permit.”

As it should be in all 50 states.

Concealed carry permits issued by states would operate similarly to drivers licenses. Holders may operate a vehicle in all 50 states but must abide by the location’s laws, such as speed limits and traffic regulations.

Commerford lauded HR 38 as a significant opportunity to right a wrong. 

“The right of self-defense shouldn’t end simply because you cross the state line,” he explained. “Passage of HR 38, concealed carry reciprocity, would be the most monumental win for gun rights since 2005, when the Protection of Lawful Commerce and Arms Act was passed.”

Of course, anti-gun radicals were quick to denounce this long overdue recognition of Second Amendment rights. Emma Brown, executive director of Giffords, claimed that constitutional carry reciprocity would bring death and destruction to the United States.

“This legislation is a dramatic infringement on states’ rights and would be disastrous for gun crime and law enforcement safety in our country,” she declared. “Violent crime rises when state concealed carry standards are weakened, and this would weaken the standard in every single state. It would also endanger police and make their jobs harder.”

The Firearm Due Process Act, or HR 2184, would address errors in the National Instant Criminal Background Check System (NICS) that prevent otherwise qualified applicants from being approved to purchase a weapon.

Prospective buyers may appeal judgments against their application to purchase a weapon due to errors. HR 2184 would mandate that their appeal be determined within 60 days of filing. 

If the process takes longer than two months, the citizen may obtain a court judgment.

Commerford explained how these purchasers are affected by paperwork errors and the golden opportunity to fix this situation.

“If your name is John Smith and you fill out a NICS check on Black Friday at Cabela’s to buy a firearm, you’re going to be in for a wait, and sometimes you’re going to be in for clerical errors that could restrict that [purchase].”

The NRA’s Commerford added that the political climate currently in Washington is advantageous for gun rights supporters.

“With a pro-gun House, a pro-gun Senate, and a pro-gun president in the White House, now is the time to put the foot on the gas and try to restore Second Amendment rights of America’s gun owners.”
