The National Shooting Sports Foundation (NSSF) strongly endorsed a congressional proposal to protect firearm trace data.
The Law Enforcement Protection and Privacy Act, sponsored by Rep. Clay Higgins (R-LA), will improve safeguards against potential misuse of firearm trace data.
Specifically, it adds strength to the Tiahrt amendment, which became law in 2003 but does not provide protocols for enforcement. This meant that the embattled Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) could circumvent the law with impunity—and it often did.
The previous administration sought its repeal, but Higgins wants to enable true enforcement and give the law teeth.
Why is trace data so important?
The National Tracing Center (NTC) operates under the ATF. Its stated mission is “to conduct firearms tracing to provide investigative leads for federal, state, local, and law enforcement agencies.”
The NTC website says it supplies “critical information” for solving crimes, detecting firearms trafficking, and the movement of guns involved in crimes.
Unfortunately, many in the anti-gun community seek to weaponize data from the NTC—thus Higgins’ bill. This is a direct response to last year’s egregious and almost undoubtedly illegal disbursement of trace data by anti-gunners to smear the firearms industry as the cause of violence.
Lawrence G. Keane, NSSF Senior Vice President and General Counsel, heaped praise on the new bill.
“This legislation is long overdue and necessary to send a strong message that there will now be consequences for those who would unlawfully disclose law enforcement sensitive firearm trace data that jeopardizes ongoing criminal investigations and puts the lives of law enforcement officers, undercover agents, and witnesses at risk,” Keane explained.
Potential consequences include fines up to $25,000 for multiple disclosures, loss of access to the ATF data, and legal recourse by federal firearms licensees (FFLs) against those who illegally released their information.
