Oregon citizens who refuse to relegate Second Amendment rights to second-class status are now forced to wait for a definitive ruling on the contentious Measure 114.

The sweeping gun control package passed in November 2022 with a scant 50.7 percent voter approval. Passage came almost entirely through support in the state’s western urban areas, and citizens in nearly every other jurisdiction flatly rejected losing their constitutional freedoms.

Eastern Oregon, home to a large population of gun owners, showed its disgust at the prospect of losing its precious liberties. 

Now, a three-judge panel of the Oregon Court of Appeals decided to extend the legal limbo further. Last week, they declared their intent to “take under advisement” arguments presented in the appeal of a lower court ruling against the pending law.

Harney County Circuit Judge Robert S. Raschio enraged anti-gun forces when he determined that Measure 114 does not withstand scrutiny under the Oregon Constitution. 

The Oregon Department of Justice requested that the appeals court overturn Raschio’s ruling. No matter the eventual ruling, the state Supreme Court will almost certainly take it up.

Along with new restrictions on gun magazines, law-abiding citizens would be forced to obtain a government permit and pass a gun safety course before being allowed to purchase a weapon.

Added to the grueling process is another background check.

Prospective gun owners in Oregon are already required to submit to a background check. Suppose Measure 114 is allowed to take effect. In that case, it will mean a second and redundant background check that serves no purpose but to add to the expense and inconvenience of exercising a cherished constitutional right.

The legal controversy gripping the state appears to be far from over. The Oregon Firearms Federation noted that a definitive decision by the appeals court was not expected, and it will likely be several months before one is forthcoming.
