In a cautionary tale for the limits of justifiable self-defense in some jurisdictions, a Philadelphia man has been charged with murder and other felonies after shooting an alleged car thief.
Police believe 39-year-old Sherwayne Garrison shot and killed a 48-year-old suspect last week. The deceased was later identified as Moneer Farhat.
According to reports, Garrison stopped at an ATM in the city’s Frankford neighborhood and left his Honda running and unlocked. It was about 3:00 p.m. on Friday, and the incident was captured on surveillance video.
The temptation was apparently too much for the suspect, who took the golden opportunity to jump into the vehicle and attempt a getaway. He did not get far.
Investigators believe that as the 48-year-old suspect drove away, Garrison drew his weapon and fired a single shot. He is a registered gun owner and has a permit to carry his firearm.
The shot struck the suspected thief in the head. The car began veering down the street before eventually colliding with a taxi. The taxi driver, Jacques Sylvain, told reporters that the weaving car raced toward him.
He recalled, “I see the car coming like zigzag, coming straight at me.”
Farhat was transported to Temple University Hospital, where he was pronounced dead. After an investigation, felony charges were leveled against Garrison for the shooting.
He now faces serious trouble for what many would deem self-defense.
However, it is generally unwise to fire a weapon during a nonviolent property crime. Philadelphia is known for prosecutors who are lenient on criminals and tough on gun owners, and Garrison faces a long and uphill battle in the courts.
