The Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) is under extreme fire for what gun rights advocates charge are years of undermining the Second Amendment.
Some prominent lawmakers even call for it to be dismantled altogether, a once unthinkable act that is suddenly in the realm of possibility.
Now comes word that court documents revealed the ATF is stubbornly clinging to an infringement on gun rights that is blatantly illegal. The troubled agency in 2023 enacted a new rule that not only reversed over a decade of stated policy but also created yet another violation of constitutional rights.
The ATF arbitrarily and unilaterally ruled that firearms equipped with stabilizing braces were suddenly transformed into short-barreled rifles (SBRs).
This meant they were now regulated by the National Firearms Act of 1934 and essentially illegal. Millions of law-abiding Americans were magically transformed into criminals simply for utilizing a popular firearm attachment.
Several lawsuits followed, and last June, a federal judge in Texas vacated the ATF rule, making it null and void. That should have ended the ill-conceived pistol brace ban.
However, the agency reportedly continued to advise gun owners that utilizing these stabilizing braces meant mandatory registration as an SBR.
This is shown in a case reported to the National Rifle Association (NRA) last week involving the alleged possession of an SBR. In US v. Taranto, the ATF appears to be clinging to the vacated rule despite the court’s decision.
The defendant was charged with having a pistol equipped with a stabilizing brace and, thus, an SBR. Even as the ATF claimed it was not enforcing the defunct rule, it reportedly used the same criteria to deem the defendant’s weapon to be illegal.
The shocked defense attorneys quickly filed a motion to dismiss, but the case remains unresolved.
