Even as Second Amendment-related businesses are protected from frivolous and potentially crippling lawsuits by federal statute, anti-gunners find novel ways to circumvent this shield.

The Protection of Lawful Commerce in Arms Act (PLCAA) was passed with bipartisan support in 2005 to ensure that the gun industry was not driven into the ground by predatory legal attacks.

Unfortunately, that has not stopped radical state and local jurisdictions from attempting to bankrupt these businesses through lawfare.

There is now significant pushback with a new measure introduced in the U.S. Senate by Mike Lee (R-UT). If passed, a system would be put in place to transfer these scandalous lawsuits to federal court.

The PLCAA already protects gunmakers from third-party actions, and this new measure would remove litigation from the state level. 

Lee explained his reasoning for sponsoring the gun rights legislation in a statement. “We cannot allow law-abiding Americans to lose their Second Amendment rights through unjust attacks on those who legally make and sell firearms. This legislation will save businesses from frivolous lawsuits and forum shopping by amending the Protection of Lawful Commerce in Arms Act, defending the right of all Americans to keep and bear arms.

Rep. Harriet Hageman (R-WY) supports a similar measure in the House. She declared that anti-gun forces are skirting current PLCAA protections and, therefore, the law needs to be enhanced.

Hageman blasted anti-gun extremists who weaponized the court system against the Second Amendment. “This legislation reinforces my commitment by ensuring radical gun control advocates cannot hurt firearm manufacturers by filing politically motivated cases in state courts.

If forces seeking to destroy the right to keep and bear arms truly respected the law, the PLCAA would be enough to protect the Second Amendment.

They do not, and that makes this gun rights measure an essential step toward ensuring these freedoms are preserved for future generations.
