The insidious practice of allowing powerful Wall Street banks to track firearm purchases by law-abiding Americans will not be established in South Carolina if certain lawmakers get their way.
House Bill 3930, the Second Amendment Financial Privacy measure, sailed through the House Judiciary Committee last week. If passed by the legislature and signed by the governor, it would ban the use of Merchant Category Codes (MCC) explicitly designed to keep a register of gun and ammunition purchases.
South Carolina would become the 20th U.S. state to prohibit such actions.
Rep. Thomas Brittain (R) declared that the bill defends the rights of gun owners. “What it does is it protects gun owners and their rights from what I call financial surveillance, which is credit card companies kind of flagging certain purchases that are made, whether it be firearms [or] ammunition.”
The South Carolina Bankers Association confirmed that most state institutions already avoid the practice to protect their customers’ privacy.
The organization’s Neil Rashley said such tracking is uncommon, at least among member institutions. “We do feel fairly confident that at least banks are not doing this in the state, or really anywhere right now, and right now, the card networks aren’t.”
In the absence of a federal law prohibiting gathering and storing this information, lawmakers across the nation are taking it upon themselves to protect the private records of gun purchasers.
The National Rifle Association (NRA) strongly supported this movement. The advocacy group announced it is currently working with South Carolina legislators to amend the bill to strengthen Second Amendment rights in the Palmetto State.
On the opposite end of the spectrum, gun-controlled California recently mandated that these MCCs be utilized to gather this sensitive data. This means that diligence such as that being pursued by South Carolina elected officials is warranted to protect consumer privacy.
