Law-abiding residents of Washington State intent on exercising their Second Amendment rights by purchasing a firearm remain out of luck as the system has been shut down for 12 days and counting.
Gun retailers are locked out of business by what officials reported is “some type of network infiltration event.” This ongoing issue swept through Washington’s Administrative Office of the Courts (AOC) system, wreaking havoc and forcing shutdowns.
One currently offline system is the AOC Enterprise Data Repository, which is significant in law enforcement’s background check program. Without this system being operational, no background checks have been carried out since the first two days of the month.
One gun rights advocacy group is threatening legal action if the logjam is not soon rectified.
The Second Amendment Foundation (SAF) informed Washington State Patrol (WSP) officials that the shutdown of gun sales is unacceptable. In a news release, the organization blasted the government for not fulfilling its constitutional duties.
“As the saying goes, ‘A right delayed is a right denied,’ and the state has denied untold numbers of citizens their right to obtain firearms for almost two weeks,” the SAF declared. “This amounts to a mass deprivation of civil rights under color of law.”
One issue is that Washington relies on its own background check system, Secure Automated Firearms E-Check (SAFE), instead of simply utilizing the FBI’s National Instant Criminal Background Check (NCIS) system.
Washington prohibits all private gun sales, meaning that legal transactions have been on hold since the start of the month.
AOC Associate Director Wendy Ferrell told the Seattle Times that officials are doing everything within their power to restore order. “In an abundance of caution, we proactively took down our systems to secure them and are working around the clock with leading experts to restore services as quickly as possible.”
Perhaps. But in a state with Washington’s recent record of hostility toward the Second Amendment, a healthy dose of skepticism is necessary.
