Columbus, Ohio’s plan to further curb the right to keep and bear arms will not take effect anytime soon, if ever, after an appeals court upheld the preliminary injunction against its pending laws.
City officials were hopeful after the Ohio Supreme Court earlier this year ruled that they could appeal the 2023 injunction blocking implementation of restrictive firearm statutes passed the year before.
This followed the Fifth Circuit initially dismissing the city’s appeal.
Judges determined that the city likely will lose its case
But on Oct. 9, the Fifth District Court of Appeals brushed aside the city’s assertion that the injunction was rife with errors. Instead, the court put the magazine-limit and firearm-storage statutes in mothballs until it settles the case.
Judges rightly noted that the Second Amendment’s clear and established protections should be the floor, not the ceiling, for gun rights in Columbus. That’s a truth that should be recognized nationwide.
The appeals court also considered U.S. Supreme Court precedents, including Bruen and Rahimi, in determining that the plaintiffs are likely to succeed in their fight against city gun ordinances.
Court win is another rung in the ladder toward full affirmation of 2A rights
Columbus authorities could still seek relief, and nothing about the case is settled except that the laws are on hold pending final adjudication of the issues.
But what is clear at this juncture is the likelihood that municipal officials overstepped their authority under the U.S. Constitution. Banning so-called “high capacity” magazines and enacting unreasonable storage requirements also runs afoul of the Ohio Constitution, which encourages efforts to keep firearm restrictions uniform across cities and counties.
It’s a victory in just one battle, but one that gun rights should celebrate. Justice is not a speedy process, and every hurdle cleared is another step toward ending Columbus’ oppressive gun control regime.
